While Quiet Listings Pty Ltd (“Quiet Listings”, “we”, “us”, “our”) endeavours to keep information current and accurate, property information may originate from third-party and publicly available sources and may change without notice.

To the maximum extent permitted by law, information on the Platform is provided on an “as is” and “as available” basis and should be independently verified before being relied upon.

2. Independent property information platform

Quiet Listings operates as an independent property information, research and discovery platform.

Unless expressly stated otherwise:

  • Quiet Listings is not the listing agent for properties displayed on the Platform;
  • Quiet Listings does not act for the vendor or buyer in relation to the sale of a displayed property;
  • Quiet Listings is not acting as a real estate agency in relation to the displayed listings; and
  • the display of an agency name, agent details, property information or a link to an external listing does not imply any affiliation, endorsement, partnership, appointment or data-syndication arrangement with that agency.

Users should contact the appointed listing agent or other authorised representative directly for official property, campaign and pricing information.

3. Property information and third-party sources

Property listings and related information on the Platform may be compiled, compared, transformed or presented using information from sources including:

  • publicly available websites and property marketing;
  • real estate agency websites;
  • third-party data providers and industry feeds;
  • public property records or datasets where lawfully available; and
  • Quiet Listings’ own observations, calculations and research indicators.

Quiet Listings does not independently verify every item of third-party information. Property details may change, be incomplete, contain errors or omissions, or become outdated after publication.

In particular, a property may be withdrawn, sold, relisted, repriced or otherwise changed before the Platform detects or reflects that change.

Users should confirm material information directly with the listing agent or other appropriate source before making any property-related decision.

4. No property, financial or professional advice

Nothing on the Platform constitutes or should be relied upon as:

  • real estate agency advice;
  • investment advice;
  • financial or credit advice;
  • legal advice;
  • tax advice; or
  • a professional property valuation.

Users should obtain independent professional advice appropriate to their circumstances.

5. Availability, status and property suitability

Quiet Listings does not guarantee that any property:

  • remains available or is currently for sale;
  • is being marketed on the same terms as when it was first observed;
  • is accurately or completely described; or
  • is suitable for any particular purchaser, purpose or use.

Campaign status, pricing information and other property details should be independently confirmed before reliance.

6. Limitation of liability

To the maximum extent permitted by law, Quiet Listings excludes liability for loss or damage arising from or in connection with:

  • use of or reliance on the Platform;
  • errors, omissions, delays or inaccuracies in third-party or publicly available information;
  • changes to property availability, status, pricing or marketing;
  • property purchase, sale, investment or finance decisions;
  • inability to access the Platform; or
  • third-party websites, services or conduct.

Nothing in this Disclaimer excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

7. Third-party links

The Platform may contain links to websites operated by listing agencies, property portals and other third parties.

Unless expressly stated otherwise, Quiet Listings does not control or endorse those websites and is not responsible for their content, availability, accuracy, security, terms or privacy practices.

External links are provided for convenience, attribution, verification or further research.

8. Intellectual property and third-party content

Quiet Listings does not claim ownership of third-party trademarks, logos, photographs, floor plans, branding or other protected material merely because that material appears in connection with a property listing on the Platform. Rights in such material remain with the relevant rights holders.

Property descriptions on Quiet Listings may be independently prepared, summarised or generated from factual and publicly available property information rather than reproducing an agent’s marketing copy.

The Platform may also display factual property information such as an address, suburb, publicly marketed status, property features, publicly advertised pricing information, campaign observations and similar objective information. The inclusion of factual information does not of itself imply ownership, affiliation, endorsement or appointment by a listing agency.

If you are a copyright owner, exclusive licensee, authorised representative or other rights holder and believe specific material on the Platform infringes your rights, please contact us and identify:

  • the specific Quiet Listings URL and material concerned;
  • the work or right you say is infringed;
  • the identity of the relevant rights holder;
  • the basis on which you are authorised to make the request; and
  • the action you request Quiet Listings to consider.

Quiet Listings will review properly particularised rights claims promptly and in good faith.

9. Content update and review requests

Quiet Listings recognises that listing agents, vendors and rights holders may from time to time wish to request a correction, update or review of information displayed on the Platform.

Factual property information

To the extent permitted by law, Quiet Listings may display factual property information derived from publicly available sources, including property addresses, property characteristics, publicly advertised campaign information, sale status and similar objective data.

The display of such information does not of itself imply a commercial relationship, affiliation or agency appointment with the selling agency or vendor.

Requests for review or correction

If you believe specific content is inaccurate, outdated, misleading or infringes a legal right, you may submit a Content Update Request to:

Requests should identify:

  • the property address or Quiet Listings URL;
  • your name, organisation and authority (where relevant);
  • the specific information or material to be reviewed;
  • the basis for the request; and
  • the correction, update or other action requested.
Our review approach

Upon receipt of a sufficiently particularised request, Quiet Listings will review the matter in good faith and, where appropriate, correct, update, modify, restrict or remove the relevant material within a reasonable timeframe.

Quiet Listings does not guarantee permanent removal of material solely because a third party does not consent to the display of otherwise lawful factual property information that remains publicly available.

Good-faith cooperation

Our objective is to maintain useful and current property information while respecting legitimate legal rights and correcting demonstrated errors promptly.

10. Search Visibility Bands and price-filtered searches

What is a Search Visibility Band?

The Platform may display a Search Visibility Band, also often referred to as a Search Band, which is a Quiet Listings research indicator designed to provide context about where a property has been observed across monitored property-search experiences.

A Search Visibility Band is not an asking price, agent price guide, property valuation, auction reserve, vendor expectation, likely sale price, or representation of a price that a seller will accept.

How Search Visibility Bands are calculated

Search Visibility Bands are independently calculated by Quiet Listings using observed search behaviour and other publicly available campaign information.

The calculation may take into account:

  • Observed search positioning: where a property is observed appearing across monitored price-filtered property searches;
  • Published campaign information: publicly displayed pricing or marketing information where available;
  • Consistency of observations: whether similar search behaviour is observed repeatedly or across multiple observations; and
  • Confidence adjustment: a broader or narrower range may be calculated depending on the quality and consistency of the available observations.

The lower end of a Search Visibility Band generally reflects the lowest relevant search position observed by Quiet Listings. Quiet Listings then applies its own confidence-based methodology to calculate the displayed range. Accordingly, the upper end of a Search Visibility Band is not necessarily an advertised or directly observed price.

Confidence indicators

Search Visibility Bands may be accompanied by a confidence indicator describing the strength of the information supporting the displayed band.

  • Transparent: based on an openly advertised listing price.
  • High Confidence: calculated from strong search observations.
  • Medium Confidence: calculated from observed search patterns.
  • Low Confidence: calculated from limited search observations and may therefore use a broader confidence adjustment.

Confidence indicators relate to the quality of the available search and campaign observations. They do not express certainty about a property’s market value, reserve, vendor expectations or eventual sale result.

Purpose and interpretation

Search Visibility Bands are provided to assist users in understanding property discovery, campaign visibility and how listings may surface across price-filtered searches.

They should be read as a research and visibility indicator only. Users should obtain official pricing information directly from the listing agent or other authorised source.

Jurisdiction-specific pricing notices

Property advertising and pricing requirements differ between Australian jurisdictions. Where applicable, Quiet Listings may display additional state or territory-specific notices or prescribed wording on an individual property page, including in connection with auction or no-price campaigns.

Any such notice operates in addition to, and does not alter the independent nature or methodology of, a Quiet Listings Search Visibility Band.

No reliance

Users must not rely on a Search Visibility Band or confidence indicator as a substitute for official agent or vendor pricing information, a professional valuation, financial advice or independent due diligence.

Search observations may be incomplete, change over time or reflect differences in third-party search behaviour. Quiet Listings does not warrant that a Search Visibility Band will correspond with an eventual sale price, reserve price, asking price or price acceptable to the seller.

11. Platform availability

Quiet Listings does not guarantee that the Platform will be uninterrupted, secure, error-free or continuously available.

We may modify, suspend or discontinue any part of the Platform at any time, subject to applicable law.

12. Market commentary and forward-looking information

Any market commentary, forecasts, estimates or forward-looking statements on the Platform are general in nature, may be based on assumptions and are subject to change.

Past market performance is not necessarily indicative of future results.

13. Governing law

This Disclaimer is governed by the laws of Queensland, Australia.

Subject to any rights that cannot lawfully be excluded or limited, users submit to the jurisdiction of the courts of Queensland.
